Official Rules

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.

1. ELIGIBILITY: Game open to legal residents of the fifty (50) United States, and Washington D.C. (not valid in Puerto Rico) who are 18 years of age or older at the time of entry, including employees of Bumble Bee Foods, LLC (“Sponsor”). Void outside the United States and where prohibited by law. Subject to federal, state and local laws and regulations.

2. HOW TO PLAY: For a chance to win a prize in the “BeeWell Miles Winning Label” Game (“Game”) purchase a specially marked “pink-label” of Bumble Bee Solid White Albacore Tuna in Water 5oz can or Bumble Bee Solid White Albacore Tuna in Water 5oz. 4-can pack, remove the can label, visit the Bumble Bee Foods ("Sponsor") website at www.beewellmiles.com ("Web Site") beginning April 1, 2009 at 12:01:00 a.m. Eastern Standard Time (ET) and ending October 31, 2009 at 11:59:59 p.m. ET ("Promotion Period") and enter the code number printed on the back of the label. You must be a registered user of the BeeWellMiles.com website. If you are not a registered BeeWell Miles user, you can register by visiting the Web Site and filling out a registration form with the required information. Registration is free. Registered users can log-in using your BeeWell Miles user name and password. Participants must have valid street address, P.O. box addresses will not be accepted. These rules may not be reproduced or reprinted in part or in their entirety without the express written permission of the Sponsor. FREE ENTRY METHOD: To get full rules and to enter for free by mail send your name, mailing address, email address and telephone number, along with a self addressed stamped envelope postmarked no earlier than April 1, 2009 and no later than October 31, 2009 to “BeeWell Miles Winning Label Game”; “Free Entry” PO Box 4856, Mission Viejo, CA 92690-4856. Vermont residents may omit return postage. Each free entry request must be in a separate outer postmarked envelope. Participants will be notified by mail, email or telephone whether they are a potential winner, subject to verification. Entries become property of Sponsor and will not be returned. Sponsor is not responsible for lost, late, illegible, misdirected, mutilated, incomplete, or postage-due mail/entries. No mechanical reproductions, automated, altered or forged entries allowed. Codes must be obtained legitimately. Liability for defective codes limited to replacement with another while supplied last during the Promotion Period.

3. PRIZE NOTIFICATION: If the code number you enter in your main account page is a potential winner, you will be notified by email which will contain information regarding shipment of your prize. Participants who send in a free entry request will be notified by mail, email or telephone if they are a potential prize winner and will be provided information regarding their prize shipment. All potential winning plays will be subject to verification by Sponsor, whose decisions are final and binding. A participant is not a winner of any prize, even if the winning email should so indicate, unless and until participant's eligibility and, for Grand Prize winner only, the potential winning code has been verified and participant has been notified that verification is complete. Sponsor will not accept screen shots or other evidence of winning in lieu of its validation process. Any entry that occurs after the system has failed for any reason is deemed a defective entry, is void and will not be honored.

4. HOW TO CLAIM A PRIZE: If upon entering the code number, printed on the back-side of a specially marked pink labeled Bumble Bee Solid White Albacore Tuna in Water 5oz can, you received an prize winning notification email, or if after sending a free entry request you are notified by mail, email or telephone that you are a potential winner, you are a potential winner of the prize indicated, subject to verification. The notification will contain information on how you will receive your prize. The Grand Prize spa trip prize will require the winner and guest to execute and return a notarized affidavit of eligibility and release of liability and publicity (where permitted by law), within ten (10) days of Grand Prize notification, prior to any ticketing of travel. If Grand Prize winner is a minor in his/her state of residence, prize will be awarded to a parent or legal guardian, who must complete and return all required documentation. Disqualification of winner, return of Grand Prize notification or any prize as undeliverable will result in forfeiture of Prize. Failure to comply with any requirement of the Game Official Rules may also result in forfeiture of Prize. 5. PRIZES / ODDS OF WINNING: Grand Prize (1): One (1) Grand Prize Winner will receive a five (5) day / four (4) night stay at a luxury Spa for two (2) people. The Trip shall include the following (which shall all be selected by Sponsor in its sole discretion): (i) Luxury Spa accommodations (single room double occupancy) spa accommodations; (ii) round-trip coach class air transportation (including taxes) for Winner and his/her Travel Companion from a major airport near the Winner's residence to an airport serving the Spa, winner and guest must travel together on the same itinerary; (iii) three (3) daily on-site meals for two (2) people, excluding alcoholic beverages; (iv) full use of all spa amenities; (vi) $1,500 total in spending money. Game ends on the date specified or when all prizes have been awarded whichever occurs first. Sponsor reserves the right to substitute a prize of equal or greater value should an advertised prize be unavailable. Return of any prize or return of prize as undeliverable will result in forfeiture of prize and that prize may become available to another winner. If an error of any kind causes more than the intended number of winning prize notices to be distributed, the prize pool of remaining prizes will be awarded in a random drawing from among all remaining eligible prize claimants. No more than the advertised number of prizes will be awarded.

6. GENERAL: Participation in the Game constitutes participant's agreement to abide by and be bound by the rules of the Game and the judges’ decisions. Except where prohibited, entry into this Game constitutes permission for the Sponsor and its designated parties to use, should they choose to do so, each winner’s name and likeness for promotion, advertising and publicity purposes at no additional compensation. Where permitted by law, winners agree to grant Sponsor the right to print, publish, broadcast and use, worldwide in any media now known or hereafter developed including but not limited to the world wide web at any time or times, each winner’s name, portrait, picture, voice likeness and biographical information as news or information and for advertising, trade and promotional purposes without additional consideration and without review, notification or approval.

   By accepting a prize, each winner waives the right to assert as a cost of winning said prize, any and all costs of redemption or travel to redeem said prize. As a condition of entering, participants (or their parent or legal guardian if an eligible minor) agree (and agree to confirm in writing): (a) to release Sponsor, its affiliates, subsidiaries, retailers, sales representatives, distributors, advertising and promotion agencies, employees, officers, and directors ("Promotion Parties") from any and all liability that might arise from redeeming or seeking said prize; (b) to release and hold harmless Promotion Parties from any and all liability, loss or damage, incurred with respect to the awarding, receipt, possession, use and/or misuse of any prize, travel related to or participation in any prize related activities and acknowledge that said parties have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to the prize; (c) under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (d) all causes of action arising out of or connected with this Game, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (e) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs. Winner will be solely responsible for paying all applicable federal, state or local taxes on prize based upon the value of the prize as set forth in these rules. Anyone who attempts to defraud Sponsor will be prosecuted and will result in disqualification and forfeiture of prize.

7. INTERNET: Sponsor is not responsible for the failure or unavailability of hardware, software, electronic communications, interrupted or unavailable network server or other Internet connections, miscommunications, failed telephone or computer transmissions or jumbled, scrambled or misdirected entries or transmissions, or for phone, electrical, network, computer hardware or software or program malfunctions, failures or difficulties or for other errors, omissions, interruptions, or deletions of any kind whether human, mechanical or electronic or for any damage to any person's computer related to participating in the Game. Sponsor is not responsible for illegible, unintelligible, late, lost or stolen entries or incorrect or inaccurate entry information, whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Game or by any technical or human errors which may occur in the processing of any entries in this Game. Persons found tampering with or abusing any aspect of the Game, as solely determined by Sponsor, will be disqualified and may be subject to prosecution. Any participant who attempts to play with multiple e-mail addresses, under multiple identities or uses any other device or artifice to play multiple times or to interfere with the proper play of this Game, will be disqualified from participation in the Game. If in the judgment of Sponsor, the Game is compromised by virus, bugs, non-authorized human intervention or other causes beyond the control of Sponsor, which corrupts the administration, security, fairness or proper play of the Game, Sponsor reserves the right, in its sole discretion to discontinue, suspend, terminate or modify the Game. In the event of any such discontinuation, suspension, termination or modification, any prizes that have not been awarded will be awarded in a fair and random manner to be determined by Sponsor following the discontinuation, suspension, termination or modification of the Game. Except for Game entry and personally identifying information which the winners agree to disclose in the Publicity/Liability Release, all personally identifiable information collected during the participant's participation in the Game will be collected and used by Sponsor, its affiliates, agents and marketers for the proper administration and fulfillment of the Game, as described in these Official Rules and in accordance with the Sponsor's privacy policy at: http://www.beewellmiles.com/PrivacyPolicy.

8. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GAME IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

9. GOVERNING LAW: In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. This Game is subject to all applicable federal, state and local laws and regulations. The interpretation of these Official Rules shall be governed by the laws of the State of California. Any and all disputes will be resolved in the appropriate courts in the State of California exclusively, and subject to the laws of the State of California. Should there be a conflict between the laws of the State of California and any other laws, the conflict will be resolved in favor of the laws of the State of California. By entering, participants consent to the jurisdiction and venue of the federal, state and local courts located in San Diego, CA.
