How to Enter: To enter the BeeWell for Life “How do YOU make it?” Contest, post a tweet containing text and/or images describing your favorite tuna recipe through your twitter.com profile (“Web Site”) between 12:01 am (ET) on March 8, 2010 and 5:00 pm (PT) on March 10, 2010 (the "Promotion Period"). Your tweet must contain the hash tag “#BWFL”. You may enter as many times as you want, but each tweet must post a new and different post and contain the hash tag “#BWFL”. Free internet access is available at many public libraries and schools and free e-mail accounts are available through a variety of providers. Must have valid e-mail address and household street address, no PO boxes accepted. This is not a sweepstakes, no mass-produced entries allowed. Mass produced entries will invalidate all entries. These rules may not be reproduced or reprinted in part or in their entirety without the express written permission of the sponsor. Prize: Twenty five (25) prizes will be awarded. Each winner will receive one (1) lunch caddy. Approximate retail value (ARV) $5.00. Prize is not exchangeable or transferable; no prize substitutions or cash alternatives allowed except as provided herein. Sponsor may substitute a prize of equal or greater value if advertised prize becomes unavailable. All prizes will be awarded provided a sufficient number of qualified entries are received. Total value of all prizes: $125. Judging: Once the entry period is over each tweet entry will be viewed and evaluated based on the following judging criteria: On topic answer (1/2); Creativity (1/4) and Originality (1/4). Final contest judging will be conducted by Anthony & Associates, an independent judging organization whose decisions are final and binding in all matters regarding this contest. In the event of a tie, tied entrants must participate in a tiebreaker question, essay or other skill-based competition designated by the judges and sponsor. For Wisconsin residents only: In the event of a tie, duplicate prizes will be awarded. Winners’ will be notified and/or receive their prize within thirty (30) days after the contest closing date. Eligibility: Contest is open to legal U.S. residents of the fifty (50) United States, including Washington D.C. (except Puerto Rico) who are 18 years of age or older, including employees of Bumble Bee Foods, LLC (“Sponsor”) at the time of entry. All entries become the property of Sponsor and will not be returned. Submission of an entry grants Sponsor and its agents the right to publish, use, adapt, edit and/or modify such entry in any way, in commerce and in any and all media, without limitation, and without consideration to the entrant. Submission of any entry further constitutes the entrant's irrevocable assignment and transfer to Sponsor of any and all rights, title and interest in and to the entry, including, without limitation, all copyrights. By accepting a prize, Winner waives the right to assert as a cost of winning said prize, any and all costs of redemption or travel to redeem said prize and any and all liability that might arise from redeeming or seeking said prize and winner releases sponsor, its affiliates, subsidiaries, employees, officers, directors, and promotion and advertising agencies from any and all liability, loss or damage, incurred with respect to the awarding, receipt, possession, use and/or misuse of any prize or participation in any prize related activities and acknowledge that said parties have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to prize including its quality, mechanical condition or fitness for a particular purpose. Winner will be solely responsible for paying all applicable federal, state or local taxes on prize based upon the published value of the prize as set forth in these rules. Sponsor is not responsible for the failure or unavailability of hardware, software, electronic communications, interrupted or unavailable network server or other Internet connections, miscommunications, failed telephone or computer transmissions or jumbled, scrambled or misdirected entries or transmissions, or for phone, electrical, network, computer hardware or software or program malfunctions, failures or difficulties or for other errors, omissions, interruptions, or deletions of any kind whether human, mechanical or electronic or for any damage to any person's computer related to participating in the Contest. Sponsor is not responsible for illegible, unintelligible, late, lost or stolen entries or incorrect or inaccurate entry information, whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human errors which may occur in the processing of any entries in this Contest. Persons found tampering with or abusing any aspect of the Contest, as solely determined by Sponsor, will be disqualified and may be subject to prosecution. Any entrant who attempts to play with multiple identities or uses any other device or artifice to play multiple times or to interfere with the proper play of this Contest will be disqualified from participation in the Contest. If in the judgment of Sponsor, the Contest is compromised by virus, bugs, non-authorized human intervention or other causes beyond the control of Sponsor, which corrupts the administration, security, fairness or proper play of the Contest, Sponsor reserves the right, in its sole discretion to discontinue, suspend, terminate or modify the Contest. In the event of any such discontinuation, suspension, termination or modification, the winners of any remaining prizes not yet won will be determined from among all eligible entries received to date that are unaffected by the problem, in a random drawing to be conducted by the judges following the discontinuation, suspension, termination or modification of the Contest. By entering this Contest, entrants agree that each entry becomes the property of Sponsor and that such entry may be used by the Sponsor for any proper purpose. All personally identifiable information collected during the entrant's participation in the Contest will be collected and used by Sponsor, its affiliates, agents and marketers for the proper administration and fulfillment of the Contest, as described in these Official Rules and in accordance with the Sponsor's privacy policy at: http://www.bumblebee.com/Privacy/. Any attempt to defraud Sponsor will be prosecuted and will result in disqualification and forfeiture of prize. No duplicate or multiple entries from one household will be accepted. Entries must be the original creation of the entrant, must not have won previous awards, must not have been published previously and must not infringe third-party rights. Except for contest entry and personally identifying information which the winners agree to disclose in a Publicity/Liability Release, all personally identifiable information collected during the entrant's participation in the Contest will be collected and used by Sponsor, its affiliates, agents and marketers for the proper administration and fulfillment of the contest, as described in these Official Rules. This contest is subject to all applicable federal, state and local laws and regulations. The interpretation of these Official Rules shall be governed by the laws of the state of California. Any and all disputes will be resolved in the appropriate courts in the state of California exclusively, and subject to the laws of the state of California. Should there be a conflict between the laws of the state of California and any other laws, the conflict will be resolved in favor of the laws of the state of California. -

In the event of a dispute as to the identity of a subscriber based on an e-mail address, the subscription will be declared made by the authorized account holder of the Twitter account time of entry. "Authorized account holder" is defined as the natural person who is assigned to a Twitter account and e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the Twitter account. This offer is subject to all applicable federal, state and local laws and regulations. The interpretation of these Official Rules shall be governed by the laws of the State of California. Any and all disputes will be resolved in the appropriate courts in the State of California exclusively, and subject to the laws of the State of California. Should there be a conflict between the laws of the State of California and any other laws, the conflict will be resolved in favor of the laws of the State of California. By entering, subscribers consent to the jurisdiction and venue of the federal, state and local courts located in San Diego, California.
